Agreement to Terms
These Terms and Conditions ("Terms") govern your use of TopK Agency's website and services. By accessing our website or using our services, you agree to be bound by these Terms.
If you disagree with any part of these Terms, you may not access our website or use our services.
Services Description
TopK Agency provides digital modeling and AI-generated content creation services, including but not limited to:
- •Hyper-realistic digital model images and videos
- •Custom digital model creation
- •Brand-specific content generation
- •Marketing and advertising content
All services are provided subject to availability and acceptance of your order by TopK Agency.
Ordering and Payment
Order Placement
When you place an order with TopK Agency:
- You must provide accurate and complete information
- Your order constitutes an offer to purchase services
- We reserve the right to accept or decline any order
- Order confirmation will be sent via email upon acceptance
Payment Terms
- →50% upfront: Due upon order placement to initiate project
- →50% before delivery: Final payment required before receiving completed files
- →All prices are in USD unless otherwise stated
- →Payment processing fees may apply
- →Late payments may result in project delays or cancellation
Delivery and Timeline
- •Standard delivery: Maximum 2 working days from strategy session completion
- •Rush delivery: Available for additional fee (contact for pricing)
- •Delivery timelines are estimates and may vary based on project complexity
- •Files will be delivered via Google Drive or similar secure platform
- •You are responsible for downloading and backing up delivered files
- •We retain delivered files for 30 days after delivery; after that, re-delivery may incur fees
Revisions and Modifications
- ✓5 free revisions are included with every order
- ✓Revisions must be requested within 7 days of delivery
- ✓Revisions are limited to adjustments within the original project scope
- ✓Additional revisions beyond 5 are available at extra charge (pricing varies by scope)
- ✓Major scope changes may require a new order
Intellectual Property and Usage Rights
Your Rights
Upon full payment, you receive:
- Non-exclusive, worldwide, perpetual license to use the delivered content
- Right to use content for commercial purposes (advertising, marketing, sales)
- Right to modify and edit the content for your business needs
Restrictions
You may NOT:
- Resell, redistribute, or sublicense the digital models or content
- Claim ownership or authorship of the digital models
- Use content for illegal, defamatory, or harmful purposes
- Reverse-engineer or attempt to extract the AI models
- Use content in ways that violate third-party rights or applicable laws
TopK Agency Rights
TopK Agency retains:
- •All rights to the underlying digital models and AI technology
- •Right to use delivered content in our portfolio and marketing materials (unless otherwise agreed)
- •Right to create similar content for other clients
Warranties and Disclaimers
Service Warranty
We warrant that our services will be performed with reasonable care and skill. However:
- •Services are provided "as is" without warranties of any kind
- •We do not guarantee specific business results or outcomes
- •AI-generated content may have limitations and imperfections
- •You are responsible for reviewing content before use
Limitation of Liability
To the maximum extent permitted by law:
- •TopK Agency's total liability shall not exceed the amount you paid for the specific service
- •We are not liable for indirect, incidental, special, or consequential damages
- •We are not liable for lost profits, revenue, data, or business opportunities
- •We are not responsible for your use or misuse of delivered content
Client Responsibilities
As a client, you agree to:
- Provide accurate information and clear project requirements
- Respond to communications in a timely manner
- Review and approve deliverables within specified timeframes
- Make payments according to agreed terms
- Use content in compliance with these Terms and applicable laws
- Not engage in fraudulent, abusive, or illegal activities
Termination
Either party may terminate the service agreement:
- →By mutual written agreement
- →If the other party breaches these Terms and fails to remedy within 7 days
- →TopK Agency may terminate immediately if you violate usage restrictions or engage in illegal activities
Upon termination, you must cease using any delivered content if full payment has not been made. Refunds will be handled according to our Refund Policy.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Jordan.
Any disputes arising from these Terms or our services shall be resolved through:
- 1.Good faith negotiation between parties
- 2.Mediation, if negotiation fails
- 3.Arbitration or courts of Jordan, as a last resort
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
